I. Background Napster is a company that lets you download music from their Internet site onto a MP3 and/or MIDI device. Shawn Fanning, who is now twenty-two years old, created Napster. He started this company from his apartment, in San Mateo, California. Napster was created a few years ago. Hank Barry is the attorney and CEO (Chief Executive Officer) of Napster. Any user with Internet access and the right computer speed can download hundreds of songs from over a million choices. There is no limit to the number of songs that con be downloaded this way. The reason why so many people use it is because all of the songs are free instead of going to the store and purchasing the CD, record or cassette. The RIAA (Recording Industry Association of America) is a company that represents most singing artists. RIAA makes their money from the sale of CD’s, records and cassettes. The RIAA decided to sue Napster because they felt that the RIAA was being cheated out of money that was rightfully theirs. Since Napster has been giving away music for free, RIAA has not made any profits on their music. They are not making any money because Napster is performing copyright infringement. This means that Napster was breaking the copyright law by allowing people to steal and trade music illegally.
